SUBJECT: Disposition of Geothermal Rights
NOTICE OF DISPOSITION
Crown reserve geothermal rights are disposed of under section 5 of the Geothermal Resources Act.
Notices of Public Tender for geothermal rights are published in the British Columbia Gazette and posted on the Ministry website at: http://edit.empr.gov.bc.ca/Titles/OGTitles/geothermal/Pages/default.aspx approximately six weeks prior to disposition. Accepted offers will be released the day following the disposition.
PROCEDURES AND CONDITIONS:
Bid Submission:
All bids must be addressed to the Minister of Energy and Mines and mailed or delivered to:

Each bid must be submitted separately in a sealed envelope, with the parcel number clearly marked on the outside.
Bid Acceptance:
The Minister of Energy and Mines reserves the right to reject any or all bids received. Bids must be received by the Executive Director, Titles Branch, Titles and Corporate Relations Division before 12:00 noon on the disposition date. Late bids will not be accepted.
Once submitted, all bids are irrevocable after 12:00 noon on the disposition date. A bid has won if and when it appears on the list of winning offers release by the Minister of Energy and Mines the following day.
The Minister of Energy and Mines reserves the right to rescind acceptance if an error has been made in the bid review process. If, in the period between the release of the list of accepted offers and execution of the permit documents for a parcel, it is found that an error has been made in determining the highest bid offered for the parcel, the Minister of Energy and Mines may refuse all bids submitted for that parcel.
In making a bid, the bidder agrees that the acceptance of a winning bid by the Minister of Energy and Mines will result in the issuance of a permit to the bidder and actions by the Minister to enforce payment of the total bid amount. A blank permit is available for viewing on the internet at:

Bid Letters:
Bid letters must include the following information:

· A statement of address to the Minister of Energy and Mines; |
|
· A statement that the bidder has read and understands the terms and conditions for the disposition; |
|
· The identifying parcel(s) number(s) for the permit shown in the disposition notice; |
|
· The correct PAD code for the company responsible for tender payment (see TITLES-03-05 for instructions on obtaining a PAD code); |
|
· The correct full name of the party to which the permit will be issued; |
|
· The total amount tendered (including issuance fee, the first year’s rent and bonus bid) –
i.e. ($500) + ($1 * (# of ha)) + ($ bonus bid) = Total Bid Amount; |
|
· The address for correspondence relating to the bid letter (must be of the party to which the permit will be issued); and |
|
· The name and signature of the person submitting the bid.
A sample bid letter is available for use in providing the above information. Use of the sample forms is not mandatory, but the bid letter must contain the information listed above. |
Remittances:
A successful bid payment must be made by using the Electronic Funds Transfer (EFT) via the Ministry’s Pre-Authorized Debit (PAD) program.
How to Register for the PAD Program:
Companies wishing to register for PAD must submit the following completed forms to Brenda Jennings, Division Operations and Revenue Systems Branch, Titles and Corporate Relations Division by email at Brenda.Jennings@gov.bc.ca.

(*NOTE: This form is required only if you intend to allow agent companies to submit bids on your behalf using their letterhead and requesting that we debit your bank account).
PAD applications will be processed within two business days of receipt.

RESULTS:
A list of winning offers is released on the day following the disposition. The list may be viewed after 12:00 noon at http://www.em.gov.bc.ca/Titles/OGTitles/SalesNotices/Pages/default.aspx or may be obtained via email by contacting GeothermalTitles@gov.bc.ca or in person at:

The right to postpone a competition or amend the date of a disposition is reserved.
