EXECUTING TITLE DOCUMENTS

Titles Division

  • Documents must be signed by a signing officer of the company (President, Vice-President, Chief Executive Officer, Treasurer, Secretary or Assistant Secretary).
  • The full name and title of the signatory must be printed below the signature.
  • The signature must be witnessed or have a company seal affixed (or both).  Red or gold legal seals are not considered company seals.
  • If witnessed, the name and title of the witness must appear on the front of the document.  Affidavits of execution are not required.
  • If a signatory other than a recognized signing officer (see above) signs the document, the signatory must hold a valid Power of Attorney, registered with the Division.  Witness and company seal requirements, outlined above, also apply.
  • If a lawyer signs on behalf of a company, the lawyer must have a valid Power of Attorney registered with the Division.  Witness and company seal requirements, outlined above, also apply.
  • Please return one copy of the fully executed document to the Division (see below).
